Terms and conditions agreement

EverAI's website is available to users worldwide. By creating an account or using this website you are deemed to have accepted and agreed to be bound by these terms and conditions and to comply with all applicable laws and regulations. You agree not to interrupt or attempt to interrupt the operation of this website in any manner. You may not use this website if you do not accept these terms.

Service delivery

How the service is delivered

EverAI is online software (SaaS), used directly on the platform with no installation required. Once your bank transfer is completed, the system automatically activates your plan or adds the corresponding credits to your account within a maximum of 10 minutes. You receive an email notification and see your balance update directly in your account.

Service term

The full rules on how credits are created, used and converted are published under Credit terms.

Suitable devices and concurrent use

• The service runs in a modern web browser (recent versions of Google Chrome, Microsoft Edge, Safari or Firefox) on a computer, tablet or smartphone. No app installation is required.
• To upload voice samples and preview results, your device needs a microphone or audio output and a stable Internet connection.
• We place no limit on the number of devices signed in simultaneously to one account. However, an account is for a single user; sharing an account with several people breaches these terms and may lead to account restrictions.
• The service can also be used through our API. API documentation and technical limits are published in the API docs.

Main features

• Text to Speech (TTS): enter or paste text, choose a voice and model, adjust speed and intonation, then generate and download the audio file.
• Voice Cloning: upload a sample of a voice you are entitled to use; the system produces a cloned voice you can reuse for later text-to-speech runs.
• Voice Dubbing: upload an audio or video file and the system produces a dubbed version in the voice you choose.
• Studio: edit multiple lines of dialogue and multiple voices within a single project.

Restrictions during use

• The quality of a cloned voice depends on the quality, length and clarity of the sample you provide. We do not guarantee a 100% reproduction of the original voice.
• AI-generated audio may contain mispronunciations or artifacts, particularly with abbreviations, technical terms, foreign proper nouns and multilingual text.
• At peak times, generation requests may be queued and take longer than usual.
• The content you generate must comply with Usage restrictions. The system may refuse requests that show signs of a breach.

Conditions and restrictions on service provision

Time restrictions

The service is available 24 hours a day, 7 days a week, except during the scheduled or unscheduled maintenance described under Service availability.

Geographic restrictions

The service is delivered online and can be accessed from any country or territory. We do not provide the service to countries or territories where Vietnamese law or international sanctions to which Vietnam is a party prohibit it. Payment is currently supported by bank transfer within Vietnam only.

Customer eligibility restrictions

• The minimum age to use the service is 16. Users aged 16 or over may register an account and pay for it out of their own funds.
• The service is not available to anyone under 16. We do not knowingly collect the personal data of anyone under 16; where we find such data we delete it and close the account.
• Because of the nature of voice cloning, you must be the lawful owner of the voice sample or hold the written consent of its owner.

Quantity limits

Service availability

The service may be suspended or interrupted in the following cases:

• Scheduled maintenance: announced at least 24 hours in advance by email or by notice on the platform.
• Unscheduled maintenance and technical incidents: when we must resolve an issue affecting the safety or integrity of the system. We give notice as soon as we can.
• Force majeure: natural disasters, fire, large-scale power outages, telecommunications infrastructure failure, cyber attacks, changes in law or requirements imposed by competent state authorities.

During an interruption your credits are not consumed, and if the interruption lasts more than 24 consecutive hours we extend the term of your subscription by the corresponding period.

Process and response times for termination requests

1. Send your termination request to contact@everai.vn or call +84 389 468 260, quoting your registered account email and, optionally, your reason.
2. We acknowledge receipt within 24 working hours.
3. We verify and give you the outcome within 3 working days of receipt, stating when the contract ends and the amount refunded, if any.

Plan changes and refunds

EverAI is a digital product delivered and consumed immediately after payment, so the general rule is no refunds. We support plan changes instead. The specific cases are set out below.

Cases where no refund is given

• You have started using the service, that is, a generation, cloning or dubbing request has been made against the package you bought.
• You changed your mind, no longer need the service, or bought the wrong plan. Buying the wrong plan is handled by a plan change.
• You ask to delete your account or to terminate before the end of the cycle you have paid for.
• Your account is terminated for a serious breach of these terms or of the law.

Plan changes instead of refunds

If you bought the wrong plan and have not used any credits from it, you may switch to a different plan within 3 days of payment:

• Switching to a more expensive plan: you pay the difference.
• Switching to a cheaper plan: the difference is kept as credits in your account, not returned as money.
• Each transaction may be changed once.

Cases where a refund is given

We refund where the fault lies with us or where you have overpaid:

• You transferred too much, or paid several times for the same order: the excess is refunded in full.
• A technical failure prevents us from delivering the service within 24 hours of your successful payment: 100% of the amount paid is refunded.
• We discontinue the service: we refund the value corresponding to the unused credits of any paid plan.

How refunds are paid

Send your request with the transaction reference and receiving account details to contact@everai.vn. Once we confirm the request is valid, the refund is made by bank transfer back to the account used for payment, within 7 working days. You pay no processing fee; any transfer charges are borne by us.

This policy does not restrict the rights granted to you by consumer protection law.

Procedure

1. You submit a request through any channel above, providing: your registered account email, a description of the issue, when it happened, and any supporting evidence (transaction reference, generation request id, screenshots).
2. We acknowledge receipt and issue a tracking reference by email, within the initial response time listed below.
3. We investigate using system records. If we need more information we contact you once, and you have 5 working days to supply it.
4. We notify you of the outcome and the proposed resolution in writing by email, within the resolution time listed below.
5. You respond to the outcome. If you disagree, you may ask us to review it once within 7 days of receiving it; we reply within 5 working days.
6. If we still cannot agree, the parties resolve the matter by negotiation and conciliation. Failing that, the dispute is referred to the competent People's Court of Vietnam.

Response and resolution times by issue type

Tools we use to resolve issues

• Transaction history in your account, showing every top-up and its reference, used to reconcile payment disputes.
• Credit usage history, recording each generation request with the credits consumed and the time it ran.
• Stored output files in your account, so you can download them again and compare quality.
• System logs recording the time and processing status of each request, which we extract when investigating a complaint.
• Free regeneration or credit refunds where we establish that the fault lies with our system.
• Temporary removal or blocking of content showing signs of intellectual property infringement, carried out together with the rights holder while we investigate.

Usage restrictions for voice cloning and TTS

When using EverAI's synthesis and voice cloning features, you represent, warrant and agree that:

• You will not use the voice of any third party without their explicit prior written permission or consent. You assume full responsibility for copyright and any disputes relating to uploaded audio samples.
• You will not use cloned voices to impersonate others, perform scam or phishing calls, fake an identity, defame, slander, or commit any other violation of Vietnamese law.
• You will not use our services to generate harmful or offensive content, historically distorted or anti-state content, or any content that violates the law or the fine customs of Vietnam.

Intellectual property and ownership of cloned voices

You retain ownership of your original voice data. By using the voice cloning feature you grant EverAI a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify and adapt your voice data solely to create and provide your cloned voice and to improve our services. EverAI will not sell or share your original voice data with third parties without your explicit consent, except as set out in our Privacy Policy. The quality of the cloned voice depends on the quality and clarity of the sample you provide; EverAI does not guarantee a 100% perfect replica of the original voice.

Rights and obligations of the parties

Rights and obligations of EverAI (platform owner)

• Issue, publish and implement the operating conditions and transaction conditions of the platform, set out under Conditions and restrictions on service provision.
• Establish and publish service standards and the process for using the platform, set out under Service delivery.
• Charge service fees strictly in accordance with the published pricing policy on the Pricing page. We charge nothing beyond the listed price.
• Provide full information on any promotion applicable to you before you confirm an order, including bonus credits and the corresponding discount.
• Ensure safe, stable and continuous operation of the platform, except in the cases set out under Conditions and restrictions.
• Clearly define and correctly apply the cases in which a user account is suspended, restricted or terminated, set out under Service termination and refunds.
• Apply the measures necessary to protect users' business confidentiality and consumers' personal information, set out in our Privacy Policy.
• Receive and resolve users' requests, feedback and complaints in accordance with the process and deadlines under Receiving and resolving feedback, requests and complaints.
• Monitor and prevent unlawful conduct on the platform; cooperate with and provide information and data to competent state authorities on request.

Rights and obligations of the seller

EverAI is a direct-sales e-commerce platform: every service on the platform is supplied by the platform owner itself, and the platform does not allow third-party sellers to register and sell goods or services. The disclosure on the rights and obligations of sellers therefore does not apply to this platform.

Rights and obligations of the buyer

• Have your consumer rights protected, and receive complete and accurate information about the service, its price and the applicable conditions before transacting.
• Choose the service and payment method that suit you; have your personal data protected; have your feedback, requests and complaints resolved as provided here.
• Provide the necessary and accurate information when registering an account and when ordering; pay in full and on time for the plan you have chosen.
• Comply with the law and with the platform's operating and transaction conditions; do not use the platform to commit unlawful acts, in particular the acts prohibited under Usage restrictions.

Limited licence

This website and all of its content, patents, copyright, trademarks and other intellectual property rights are the property of EverAI and are protected by copyright laws worldwide. You agree to comply with all copyright laws worldwide in your use of this website. EverAI grants no express or implied rights under any patents, trademarks, copyrights or trade secret information. You may not modify, copy, transmit, sell or distribute this website in whole or in part, except that EverAI grants you a non-exclusive, non-commercial, limited right to use this website. You may not use any part or the whole of this website to create part of a new website without EverAI's prior written consent.

Disclaimer of warranty

You understand that your use of this website is at your sole risk. All information, instructions, software, products, programs and services are provided on an "as is" basis. The website is provided without warranties of any kind, express or implied. EverAI does not warrant that this website will be uninterrupted, timely, secure or error-free. EverAI does not guarantee the absolute accuracy, quality or reliability of text-to-speech conversion or cloned voices. Generated audio may contain errors or artifacts due to the nature of AI technology. This disclaimer does not exclude the rights granted to you by consumer protection law.

Limitation of liability

To the extent permitted by law, EverAI will not be liable to you or any party for indirect, special or consequential damages arising from the use of our website, including but not limited to loss of data, business interruption, or legal issues arising from the audio content you generate using our services. This limitation does not apply to damage caused by our wilful misconduct or serious breach, and does not restrict any rights that cannot be waived under Vietnamese law.

Display priority policy

The platform uses no algorithm or other method to restrict or prioritise the display of plans and voices. Specifically:

• The default order is fixed and identical for every user. The voice library is grouped by language and then follows an order we set in advance for each voice. That order does not depend on paying for placement, nor on your search history, transaction history, ratings, usage counts or location.
• There is no paid placement anywhere on the platform.

How you choose and change the display order yourself

Any change to the display order is entirely your own doing, through these tools:

• Search by voice name in the voice library search box.
• Filter by language, by gender and by use case. The reset button returns the list to its default order.
• Reorder the list yourself by dragging and dropping voices where you want them. The order you set is saved to your account and applied on subsequent sign-ins, across every tool where you pick a voice.

The order you set applies to your account only and does not affect what anyone else sees. You can undo it at any time by dragging again or resetting the filters.

Disclosures that do not apply to this platform

EverAI is a direct-sales e-commerce platform with an online ordering function, supplying only digital services provided by the platform owner itself. The following disclosures required by Chapter II of Decree No. 248/2026/ND-CP therefore do not arise:

Should the platform add any of these features in future, we will publish the corresponding disclosures in full before the feature goes live.

Platform owner information

Governing law

These terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, including the Law on E-commerce No. 122/2025/QH15 and Decree No. 248/2026/ND-CP dated 30 June 2026. Any claims, legal proceedings or litigation arising in connection with these terms will be brought before the competent People's Court of Vietnam.

Changes to these terms

EverAI may amend these terms to reflect changes to the service or to the law. Amendments are published on this page together with the update date. For changes that affect your rights, in particular changes to pricing and payment policy, we publish them on the platform at least 20 days before they take effect. Your continued use of the service after that date is taken as acceptance of the amended terms.
